Kodem Law Firm is pleased to announce a string of approvals in the category of Multinational Executives and Managers under the Non-Immigrant L-1A (Intra-company Transferee) and Immigrant EB-1C (Employment Based First Preference) categories.
The L-1A and EB-1C visa categories are used for petitioning Managers and Executive Level employees of the overseas entity. While the L-1A and EB-1C visas are both used to bring in qualifying intracompany transferees from their overseas branch/subsidiary/affiliate, the eligibility requirements are of a Higher standard for the EB-1C category given that the Employment-Based First Preference visas by virtue of being at the top of the Preference Category usually have no backlogs in contrast to the other her employment-based visa categories; which acts as a crucial factor, especially for clients in regions such as India.
The key advantages of the nature of the classification of both these visa categories is seen in the fact that the L-1A Non-Immigrant visa category can also be utilized in order to setup and establish a new business in the United States; whereas the EB-1C Immigrant visa category does not have any Labor Certification requirements thus not having any bar on holding equity, unlike the requirement under the PERM for most other immigrant visa categories; making it very lucrative for high level Executives/Managers in the Company .
The applicants are screened under various criteria of which the Qualifying relationship of the two Entities and the Qualifications of the Beneficiary to perform the required duties and responsibilities in the future Managerial/Executive position are the most crucial components
EB-1C Approvals
We recently secured an approval on an EB-1C case for a Major client in the niche Pharmaceutical Industry. The Petition was filed by the client in order to further expand and grow the Parent company which had recently forayed into various new sectors in the pharmaceutical business. The highly scrutinized Pharmaceutical Industry along with the diversification of the business seemed to be an issue of concern; but we are pleased to announce that we have received an approval on the Petition within the Clients expected deadline.
L-1A Approvals
We recently secured two continuous approvals on two separate Petitions for a Major Consultancy Firm. The Petitions were filed by the client in order to further establish their dominant presence as a leading Consultant by securing approvals for two employees, one in a managerial role and the other in an executive role, respectively. The two employees hailed from two different foreign overseas branches of the client in the regions of India and LATAM, which required the expertise of our Firm in establishing such a Qualifying relationship between the entities.
